ANSWERCADDIE PRIVACY POLICY

This Privacy Policy describes how Artsol, a California corporation, doing business as AnswerCaddie ("AnswerCaddie," "we," "us," or "our"), collects, uses, discloses, and protects information in connection with the website located at answercaddie.com, our dashboards, portals, and applications (the "Website"), and our AI-powered telephone answering, voice assistant, ordering, reservation, messaging, and related services (collectively, the "Services"). This Privacy Policy is incorporated into and forms part of our Terms and Conditions of Service. By accessing the Website or using the Services, you agree to this Privacy Policy.

1. Our Role: Business Customers vs. Callers

The Services are provided to businesses ("Customers"), such as restaurants, that use AnswerCaddie to answer and manage their phone calls and communications.

• If you are a Customer (or a Customer's employee or authorized user), we collect and use your information as described in this Privacy Policy, acting as the business responsible for that data.

• If you are a caller or end customer of one of our Customers (for example, you called a restaurant that uses AnswerCaddie), we process your information — including your voice, phone number, and the content of your call or messages — on behalf of and at the direction of that Customer as a service provider/processor. The Customer's own privacy practices govern that data; direct any privacy questions or requests about your call to the business you contacted. We will refer requests we receive about caller data to the relevant Customer.

2. Information We Collect

Information you provide. Account and registration information (name, business name, email address, phone number, business address); billing and payment information (card or bank account details, which are processed by our payment processors — we do not store full card numbers on our systems); business configuration information (menus, pricing, hours, scripts, knowledge base content); and communications with us (support requests, emails, texts, feedback).

Information collected through the Services. Call data, including phone numbers, call times and durations, call recordings, voicemails, transcripts, and AI-generated summaries; message content (SMS/MMS); orders, reservations, and appointment data processed through the platform; and usage data such as features used, log data, and analytics.

Information collected automatically on the Website. IP address, browser and device type, operating system, pages viewed, referring URLs, and interactions with the Website, collected through cookies, pixels, and similar technologies as described in Section 7.

Information from third parties. Information from payment processors, telecommunications carriers, integration partners (such as POS, ordering, or reservation systems you connect), analytics providers, and publicly available sources.

3. How We Use Information

We use the information we collect to:

• provide, operate, maintain, and support the Services, including answering calls, generating AI responses, processing orders and reservations, and routing communications;

• create and manage accounts, process payments, and collect amounts owed (including through payment retries and collections as described in our Terms);

• improve, develop, and train our Services, systems, and AI models, using de-identified or aggregated data where feasible;

• communicate with you about the Services, including transactional, billing, security, and support communications, and marketing communications where permitted (you may opt out of marketing as described in Section 8);

• monitor, detect, and prevent fraud, abuse, security incidents, and violations of our Terms;

• comply with legal obligations, enforce our agreements, and protect our rights, property, and safety and those of our Customers and others; and

• for any other purpose disclosed to you at the time of collection or with your consent.

4. Call Recording, Transcription, and AI Processing

Calls handled by the Services may be recorded, transcribed, analyzed, and summarized using automated and AI technologies. Recordings and transcripts are processed to deliver the Services to the relevant Customer (for example, capturing an order or reservation) and to maintain, secure, and improve the Services. Customers are responsible for providing any notices to, and obtaining any consents from, their callers required by applicable call-recording laws, and for any disclosures required regarding automated or AI-generated communications. Callers may be informed at the start of a call that they are speaking with an automated assistant and/or that the call is recorded, where the Customer has configured such notices or where required by law.

5. How We Share Information

We do not sell personal information for money. We share information as follows:

• Service providers — hosting, cloud infrastructure, AI model providers, telecommunications carriers and SMS aggregators, payment processors, analytics, email delivery, and customer support tools, in eachuh case to perform services for us under contractual restrictions;

• Our Customers — call data, recordings, transcripts, orders, reservations, and messages are made available to the Customer whose business you contacted;

• Integration partners you or your business connect — such as POS, ordering, reservation, CRM, or accounting systems;

• Collections and credit — collection agencies, attorneys, and commercial credit bureaus in connection with unpaid balances, as described in our Terms;

• Legal and safety — to comply with law, subpoenas, court orders, or governmental requests, or to protect the rights, property, or safety of AnswerCaddie, our Customers, or others;

• Business transfers — in connection with a merger, acquisition, financing, reorganization, or sale of assets, in which case information may be transferred as a business asset; and

• With consent or at your direction.

6. Data Retention

We retain information for as long as needed to provide the Services, comply with legal, tax, and accounting obligations, resolve disputes, prevent fraud, collect amounts owed, and enforce our agreements. Call recordings and transcripts are retained in accordance with our operational retention practices and Customer configuration where available. Following account termination, we may retain information for a commercially reasonable period for these purposes, after which it is deleted or anonymized, unless retention is required by law.

7. Cookies and Similar Technologies

We and our providers use cookies, pixels, local storage, and similar technologies on the Website for authentication, security, preferences, analytics, and (where used) advertising measurement. You can control cookies through your browser settings; disabling cookies may affect Website functionality. The Website does not currently respond to "Do Not Track" browser signals, but where legally required we honor opt-out preference signals such as the Global Privacy Control for applicable users.

8. Your Communication Choices

We may send transactional, account, billing, security, and service communications by email, phone call, and SMS/MMS as described in our Terms; these are necessary to provide the Services and are not affected by marketing opt-outs. You may opt out of marketing emails via the unsubscribe link in any marketing email and of marketing texts by replying STOP. Message and data rates may apply.

9. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect information, including encryption in transit, access controls, and monitoring. However, no system, network, or method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for protecting your account credentials and for your own systems and backups. If we become aware of a breach affecting your information, we will notify you as required by applicable law.

10. Your Privacy Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or obtain a copy of your personal information, to opt out of certain processing, or to limit certain uses. California residents may have rights under the California Consumer Privacy Act, as amended (CCPA/CPRA), to the extent it applies, including the rights to know, delete, correct, and opt out of "sales" or "sharing" of personal information; we do not sell personal information for money and do not use or disclose sensitive personal information for purposes requiring a right to limit. We do not discriminate against anyone for exercising privacy rights.

If you are a caller or end customer of one of our Customers, please direct your request to that business; we will assist them in responding as their service provider. Authorized agents may submit requests with proof of authorization.

11. Children

The Website and Services are intended for business use and are not directed to children. We do not knowingly collect personal information from children under 13 (or under the age required by applicable law). If you believe a child has provided us personal information through the Website, contact us and we will delete it. Callers of any age may interact with a Customer's phone line; that data is processed on behalf of the Customer as described in Section 1.

12. Where Information Is Processed

The Services are operated from the United States, and information is processed and stored in the United States. If you access the Website or Services from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those in your jurisdiction.

13. Third-Party Websites and Services

The Website and Services may link to or interoperate with third-party websites and services. This Privacy Policy does not apply to third parties, and we are not responsible for their privacy practices. Review the privacy policies of any third-party services you use.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted on the Website with a revised "Last Updated" date, and material changes may be communicated by email or notice within the Services. Continued use of the Website or Services after the updated policy is posted constitutes acceptance of the updated policy.
